A Royse City man has been charged with opening fire on a residence in November 2011.

Rigoberto Herrera, 45, entered a plea of not guilty Monday to an indictment of deadly conduct by discharging a firearm.

The indictment was issued sealed by the Hunt County grand jury January 20 and was made public during an arraignment hearing in the 196th District Court.

Judge Steve Tittle accepted the plea and scheduled an interim hearing for March 27.

Herrera is currently in custody in the Rockwall County Jail in lieu of a $40,000 cash bond. Herrera’s attorney has filed a writ of habeas corpus, seeking a bond reduction in the case.

A hearing concerning the writ has been scheduled for February 27.

The indictment alleged Herrera was one of three people who shot at the direction of six people, and/or an occupied residence, on November 6, 2011.

The charge is a third degree felony, punishable by a maximum sentence upon conviction of from two to 10 years in prison and an optional fine of up to $10,000.
