Agreement announced in illegal dumping suit

Hearing set in Texas A&M University-Commerce building demolition, disposal suit

GREENVILLE — A hearing is scheduled in state district court later this month which may result in a final resolution of a major illegal dumping suit, involving a famous demolition company and Texas A&M University-Commerce.

In May 2012, the Hunt County Commissioners Court approved a partial settlement agreement and payment of fine from two defendants in a lawsuit the county filed against a Travis County demolition company, which made headlines when it destroyed two north Texas sports landmarks.

The county and the Texas Commission on Environmental Quality filed the suit in July 2011 against A&R Demolition Inc. of Del Valle, alleging the business illegally disposed of debris from Texas A&M University-Commerce.

Attorneys notified the 196th District Court that an agreement had been reached in the case, although no details were released. A final hearing concerning the suit is scheduled in the suit on July 16.

A&R Demolition was responsible for the destruction of Texas Stadium in Irving in April 2010 and Reunion Arena in Dallas in November 2009.

According to the suit, A&R Demolition tore down the former West Halls dormitories on the university campus beginning in July 2010, then illegally disposed of the debris at locations on County Road 4904 — identified in the suit as “the McGee property” — near Wolfe City and on County Road 4204 — identified in the suit as “the Jones property” — between Neylandville and Campbell.

The suit is seeking penalties of up to $25,000 per day since the illegal dumping occurred, for each section violated.

Should A&R Demolition be found liable, and if the maximum penalties were assessed for each violation, the total would come to more than $82 million dollars.

The company and another defendant named in the litigation, Jim Rawson of Justin, had filed general denials of all claims raised in the suit.
