Indictment dismissed in alleged armed beer robbery

GREENVILLE — Charges have been dropped against one of two Greenville men indicted for aggravated robbery for allegedly using a handgun while making an early morning beer run at a local store.

Jose Luis Montoya, 20, and Juan Martin Mendez-Camacho, 42, were indicted by the Hunt County grand jury on one count  each of aggravated robbery with a deadly weapon. Both had pleaded not guilty.

The indictment against Montoya was dismissed during a Wednesday hearing in the 196th District Court. The Hunt County District Attorney’s Office said it was seeking the dismissal “in the interest of justice.”

The status of the indictment against Mendez-Camacho was not immediately available.

The pair were alleged to have used a firerm to rob the local Wal-Mart Supercenter of beer .

A criminal complaint filed in the case alleged the pair were observed by a security officer walking out of the store at around 3:15 a.m. May 7, 2012 while carrying a case of beer. When the officer confronted the pair, one of the them allegedly threatened him with a pistol.

The pair were later apprehended by the Greenville Police Department in the 4200 block of King Street.

Aggravated robbery is a first degree felony, punishable upon conviction by a maximum sentence of from five to 99 years to life in prison, and an optional fine of up to $10,000.
