Tawakoni ballot battle headed to local courtroom

GREENVILLE — With a month to go before the election, two candidates seeking spots on the West Tawakoni City Council are scheduled to face off in a Hunt County courtroom.

Subpoenas were ordered to be issued Monday in the court battle between the current mayor of West Tawakoni and a city council member. Jury selection is scheduled for next Monday, October 15.

Today is the final day to register to vote for the November 6 election ballot, which includes a city council race in West Tawakoni.

Pete Yoho and Laura Beckett are in the race for Place 2 on the council. Carol Solomon is unopposed in seeking the Place 4 spot. Jack Schultz and Calvin Travers are competing for the post of mayor

Yoho, who is currently the mayor of West Tawakoni, City Administrator Cloy Richards and  West Tawakoni Maintenance Supervisor Gary Lamont Jenkins filed suit in October 2010 against Solomon, seeking her removal from the Council due to allegations of misconduct.

Richard and Jenkins later filed an order of non-suit and were dropped from the case.

But Yoho continued with the suit, filing amended petitions in March and December of last year.

In return, Solomon filed a counter claim against Yoho, alleging claims of defamation and malicious persecution

Yoho sought a motion for summary judgment, arguing there was no evidence for Solomon’s countersuit.

But 196th District Court Judge Steve Tittle, in an order signed March 22, denied Yoho’s motion.

Yoho’s original suit claimed Solomon and her husband Richard used city employees and equipment to remove a tree stump from their property, replace a drain culvert and grade the driveway to their residence in late May or early June 2010, without compensating the city.

Solomon has denied the allegations.
