Aggravated assault trial starting

GREENVILLE — Opening arguments and the start of testimony are expected today, in the trial of a Franklin County man, accused of attacking another man with a flashlight in the summer of 2012.

A jury was chosen in the 196th District Court Monday in the trial of Calvin Clay Penny. Penny, 49, of Mount Vernon, has pleaded not guilty to one count of aggravated assault with a deadly weapon.

The indictment was returned by the Hunt County grand jury in May 2013 and alleged Penny used a flashlight to hit a male victim in the head on July 15, 2012.

The Hunt County District Attorney’s Office has subpoenaed 12 witnesses to testify during the trial

Aggravated assault is a second degree felony, punishable upon conviction by a maximum sentence of from two to 20 years in prison and an optional fine of up to $10,000.
