He’s in the Army now — Pot charge dismissed after defendant agrees to enlist

GREENVILLE — An East Texas man has avoided prosecution on a felony marijuana possession charge by agreeing to volunteer to serve in the Army.

A charge of possession of between four ounces and five pounds of marijuana, filed against Antwain Dewayne Chism, 27, of Linden in Cass County, was dropped Thursday during a hearing in the 196th District Court.

The office of Hunt County District Attorney Noble D. Walker Jr. filed a motion seeking to dismiss the charge, after receiving a letter from the United States Army indicating Chism intended to enlist.

“In consideration of the defendant’s desire to serve, this case is being dismissed,” the motion stated, adding that if Chism changed his mind about joining the Army, “ ... the State shall have the right to refile this case and seek a new indictment on this charge.”

Chism was arrested in Hunt County on Jan. 7 on the charge, which carried a maximum punishment upon conviction of up to two years in a state jail facility.
