Construction company denies Quinlan ISD allegations

A Richardson-based construction firm being sued by Quinlan Independent School District has filed a response denying the school district’s allegations that the firm defectively constructed the district’s high school.

In late October, QISD officials filed a suit against Richardson-based Dalmac Construction Co. — the construction company that built Quinlan-Ford High School — for breach of contract, negligence and breach of warranty alleging that the school was defectively constructed.

“(Dalmac Construction Co.) enters a general denial, denying each and every, all and singular, the allegations contained in the Plaintiff’s Original Petition and demands strict proof thereof by a preponderance of the evidence,” reads court documents submitted by Dalmac’s Dallas-based lawfirm Miller & McCarthy.

In addition, the firm is asking that Dalmac Construction recover all costs and other relief as deemed appropriate or necessary.

According to the QISD’s suit, which was filed on behalf of the school district by Austin lawfirm Powell and Leon, LLP, the district has faced a plethora of problems ranging from sewage issues, to cracks to a shifting foundation since the school first opened in August 1999.

The district is seeking unspecified damages as well as attorney’s fees.
